Industrial court set aside order on Kwara’s ex-Auditor General
• Says he concealed material facts, misled Court on ‘completed act’
The Industrial Court sitting in Akure, Ondo State capital, has vacated an earlier order restraining the Governor of Kwara State from directing the sacked Auditor General to hand over his office.
In a ruling on Monday on motion on notice filed by the government, the court said Mr. Muyiwa Adeyeye, the sacked Auditor General, had secured the order “through misrepresentation of facts on a completed act”.
Consequently, the court granted an order “discharging, setting aside and/or vacating ex debito justiciae, the order of interim injunction made ex parte by this Honourable Court on 2nd day of March, 2022, the claimant having obtained same by misrepresentation and/or concealment of material facts”.
The court also held that the act which the “claimant sought and obtained interim injunction to restrain was a completed act”.
The order has since been served on the former Auditor General.
